Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and ToRecruit regarding your use of the ToRecruit platform, website and related services (together, the "Service"). Please read them carefully. By creating an account, completing onboarding or otherwise using the Service you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy, Cookie Policy, Acceptable Use Policy and Refund Policy. If you do not agree, do not use the Service.

About ToRecruit

ToRecruit is a recruitment platform and staffing agency that connects people who are looking for a job ("Candidates") with organisations that hire ("Companies"). We operate the Service under the brand "ToRecruit". References to "we", "us" or "our" mean the legal entity that operates ToRecruit and acts as the service provider and, where applicable, data controller.

The Service can be accessed from anywhere in the world, but it is designed for users located in Ukraine, the European Economic Area and other jurisdictions that recognise equivalent privacy and consumer-protection standards. You are responsible for ensuring that your use of the Service is lawful in your location.

What the Service does

The Service is a multi-sided marketplace. It provides three distinct but related offerings, each of which is explicitly disclosed to you before you submit data.

  • Profile marketplace. Candidates voluntarily build a profile (skills, seniority, bio, portfolio, work preferences). Companies can browse these profiles and pay us a fee to unlock a full profile card, including the Candidate's self-reported hard skills, soft skills and experience.
  • Contact unlock. When a Company decides that a Candidate's public profile fits an open role, the Company may pay us a fixed fee (for example, USD 30 per unlock; the actual amount is shown at purchase) to receive the public contact data the Candidate entered during onboarding - phone number, messenger handles (Telegram, WhatsApp, Skype, LinkedIn etc.), public social links and usernames. After unlock, the Company contacts the Candidate directly.
  • Recruitment with success fee. We may also act as a staffing agency: we search our database for Candidates who match a Company's open vacancy and introduce them. In this mode we are paid a success fee by the Company only after the Candidate has completed a probation period agreed with the Company (typically one month).

By registering as a Candidate and completing onboarding, you expressly authorise ToRecruit to use your profile data for all three offerings above, without a separate approval per transaction. You can withdraw that authorisation at any time by closing your account or by adjusting the relevant settings, in which case we will stop future uses - see Section 6 and the Privacy Policy.

Eligibility and account

To create an account you must be at least 16 years old (or the minimum age for data processing consent in your country if that age is higher) and legally able to enter into a binding contract. The Service is not directed at children.

You are responsible for keeping your login credentials secure and for everything that happens under your account. You must provide accurate information, keep it current and promptly correct anything that becomes inaccurate. One natural person may hold only one Candidate account; a legal entity may hold only one Company account per legal name.

If you register on behalf of a Company, you represent and warrant that you have authority to bind that Company to these Terms.

Candidate terms

As a Candidate you choose what information to publish on ToRecruit. Nothing is automatically imported: every field (personal details, skills, CV, phone, social profiles, salary expectations) is entered by you at registration, during onboarding or later from your profile page.

By populating your profile and by selecting the "looking for a job" status you confirm that you actively want to be discovered by potential employers. You therefore acknowledge and agree that:

  • We may display your public profile (excluding legal name, date of birth, exact address, salary and private notes) to Companies searching for talent.
  • We may include your data in matching lists that we share with Companies as part of our staffing-agency activity, without asking you before each introduction.
  • We may sell your public contact data (phone, messenger handles, social links) to Companies that pay the contact-unlock fee. You agree that we are not required to obtain an additional confirmation from you before each sale, because your onboarding submission already constitutes that consent.
  • After a Company unlocks your contacts, that Company becomes an independent data controller and will use your contacts to reach out to you. We cannot control what the Company does with your contacts after disclosure, but every Company must accept our Acceptable Use Policy before unlocking contacts.

You warrant that all information you upload - including CV, certificates, portfolio links and photos - is true, belongs to you or is used with the necessary rights, and does not infringe anyone else's rights. You grant us a worldwide, royalty-free, non-exclusive licence to host, display, translate, summarise and share that content with Companies strictly for the purposes described in Section 2. This licence ends when the relevant data is deleted, except for copies already lawfully disclosed to a Company.

You can change your job-search status to "not looking" at any time. When you do, we will stop listing you in new Company searches, will stop new contact-unlock sales, and will hide your public profile from new viewers. Disclosures made before the change cannot be reversed.

Company terms

As a Company you use the Service to find Candidates. You agree to use Candidate data only for legitimate recruitment and hiring purposes within your organisation. You must not resell, publish, scrape, or disclose Candidate data to third parties, and you must not use it for advertising, credit scoring, background checks unrelated to the hiring process, or any discriminatory purpose. The full list of prohibited uses is in our Acceptable Use Policy.

Contact unlocks, featured profile access and other paid features are billed at the price displayed at checkout. Prices may change from time to time; the price that applies to a given purchase is the one shown to you at the moment of purchase.

For the recruitment-with-success-fee model, a separate written engagement between the Company and ToRecruit will set the success-fee percentage, the probation period and other commercial terms. These Terms govern platform usage; they do not replace that engagement.

By acting as a Company you confirm that the person placing the order has authority to commit the organisation and that the organisation will comply with applicable labour, anti-discrimination and data-protection law in the country where the Candidate resides.

Your consent, and how to withdraw it

Registration, onboarding and every data-collection form on ToRecruit operate on an opt-in basis: you decide which fields to fill in, and submitting a form is your active consent to the specific use described next to that form (for example, uploading contact data next to the text "These contacts may be shared with Companies that purchase unlock").

You can withdraw consent at any time by: (a) removing the relevant field from your profile; (b) changing your job-search status to "not looking"; (c) requesting account deletion at privacy@torecruit.org; or (d) using the self-service controls inside your profile when available.

Withdrawing consent stops future processing but does not undo processing that already happened - for example, a contact unlock sold before withdrawal remains with the Company that bought it. We will, on your written request, inform that Company of your withdrawal and ask it to stop contacting you.

Payments, fees and taxes

Paid features for Companies are charged through our payment processor. By paying, you authorise the charge of the displayed amount (plus applicable taxes) to your chosen payment method. We do not store full card numbers ourselves - payment data is handled by the processor in accordance with PCI-DSS.

Where required by law, the price shown includes VAT or is quoted excluding VAT with a clear note; the invoice you receive after payment is the authoritative document.

Refunds and cancellations are governed by our Refund Policy. Paid contact unlocks are considered digital services delivered immediately upon purchase, and refunds are limited as described in that policy.

Intellectual property

ToRecruit owns the Service, the platform software, the brand and all associated materials. Nothing in these Terms transfers ownership of those assets to you.

You keep ownership of the content you upload (CV, texts, portfolio). You grant us the licence described in Section 4 only for running the Service. Companies that unlock your contacts or receive a matching introduction receive a limited, internal-use licence to the disclosed data for the purpose of evaluating and communicating with you about a role.

Feedback, suggestions or ideas you send us about the Service may be used by us without restriction and without compensation.

Prohibited conduct

You agree not to, and not to help anyone else:

  • Create fake, impersonating, automated or misleading profiles;
  • Scrape, crawl, mirror or bulk-download Candidate or Company data by any means;
  • Use the Service to contact Candidates for purposes other than a genuine hiring opportunity, or to send unsolicited commercial messages;
  • Discriminate against Candidates on the basis of age, sex, race, ethnicity, religion, disability, sexual orientation, political belief or any other protected characteristic;
  • Upload viruses, malicious code, or attempt to reverse-engineer, disrupt or circumvent the Service;
  • Use the Service in any way that violates applicable law, including export-control, sanctions, labour, tax or data-protection law.

A breach of this Section, the Acceptable Use Policy or the Privacy Policy may result in immediate suspension or termination of your account and legal action.

Suspension and termination

You can close your account at any time from inside the Service or by writing to support@torecruit.org.

We can suspend or terminate access, remove content or refuse a transaction if we reasonably believe that you are in breach of these Terms, that keeping your account active poses a risk to other users or to the integrity of the Service, or that we are required to do so by law.

After termination we will keep certain data as described in the Privacy Policy (for example, transaction records required for tax and anti-fraud purposes). Disclosures already made to Companies cannot be recalled.

Warranties and liability

We provide the Service "as is" and "as available". We do our best to ensure the Service works, but we cannot guarantee a particular outcome - for example, that a Candidate will receive an offer or that a Company will find a suitable hire. We do not verify every statement made by a Candidate or a Company.

To the maximum extent allowed by law, ToRecruit is not liable for indirect, incidental, special, punitive or consequential damages, for lost profits, lost revenue, lost goodwill or lost data, even if we have been advised of the possibility of such damages. Our total liability to any single user in any twelve-month period is limited to the greater of (a) the amount you paid us during that period, or (b) one hundred euros (EUR 100).

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including for fraud, wilful misconduct or gross negligence.

Changes to the Service and to these Terms

We may change the Service, add features, remove features or change prices. When a change materially affects your rights or obligations, we will tell you by email or through a notice inside the Service at least fifteen (15) days before it takes effect. Your continued use after the effective date is your acceptance of the updated version.

If you do not accept the change you can close your account. For purchases already paid for, the version of the Terms in force at the time of purchase continues to govern that transaction.

Governing law and disputes

These Terms are governed by the law of Ukraine, unless the mandatory law of your country of residence provides otherwise. Where you are a consumer based in the European Economic Area, you also benefit from the mandatory protections of the law of your country of residence.

We will always try to resolve disputes with you amicably first. You can contact us at legal@torecruit.org. If we cannot reach an agreement, the competent courts of Ukraine have exclusive jurisdiction, subject to any mandatory consumer-protection rule giving jurisdiction to the courts of your country of residence.
